Terms and conditions for using Bot-Call

1. Acceptance of Terms

By accessing and using Bot-Call's AI telephone assistant service ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use our Service.

2. Description of Service

Bot-Call provides an AI-powered telephone assistant service that:

  • Answers incoming calls on behalf of your business
  • Handles customer inquiries and information requests
  • Manages bookings and reservations
  • Provides integration with third-party business tools
  • Offers analytics and reporting features

3. Account Registration

To use Bot-Call, you must:

  • Create an account with accurate and complete information
  • Maintain the security of your account credentials
  • Be at least 18 years old or have parental consent
  • Have the authority to bind your business to these terms

You are responsible for all activities that occur under your account.

4. Subscription and Billing

4.1 Subscription Plans

Bot-Call offers various subscription plans with different features and usage limits. You may upgrade or downgrade your plan at any time.

4.2 Free Trial

We offer a 7-day free trial with full access to features. At the end of the trial period, you will be charged according to your selected plan unless you cancel.

4.3 Billing

  • Subscriptions are billed monthly or annually in advance
  • All fees are non-refundable except as required by law
  • We reserve the right to change our pricing with 30 days' notice
  • Overages beyond included minutes will be charged at standard rates

4.4 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No refunds will be provided for partial billing periods.

5. Use of Service

5.1 Permitted Use

You agree to use Bot-Call only for lawful purposes and in accordance with these Terms. You may use the Service to:

  • Handle legitimate business communications
  • Manage customer inquiries and bookings
  • Integrate with approved third-party services

5.2 Prohibited Use

You agree NOT to use Bot-Call to:

  • Violate any applicable laws or regulations
  • Transmit spam, harassment, or abusive content
  • Impersonate others or provide false information
  • Interfere with or disrupt the Service
  • Attempt to gain unauthorized access to our systems
  • Use the Service for any illegal or fraudulent purpose

6. Content and Data

6.1 Your Content

You retain ownership of all content you provide to Bot-Call. By using the Service, you grant us a license to use, store, and process your content solely for providing the Service.

6.2 Call Recordings

Bot-Call may record calls for quality assurance and service improvement. You are responsible for:

  • Complying with local laws regarding call recording
  • Informing callers that calls may be recorded
  • Obtaining necessary consents where required

6.3 Data Ownership

You own all data collected through your use of Bot-Call. We will not sell your data to third parties.

7. Service Availability

While we strive for 99.9% uptime, we do not guarantee that the Service will be available at all times. We may experience:

  • Scheduled maintenance windows
  • Unplanned outages due to technical issues
  • Service interruptions beyond our control

We are not liable for any damages resulting from Service unavailability.

8. Third-Party Integrations

Bot-Call integrates with various third-party services. Your use of these integrations is subject to the terms and conditions of those third-party services. We are not responsible for the availability or functionality of third-party services.

9. Intellectual Property

The Service, including all software, designs, text, graphics, and other content, is owned by Bot-Call and protected by intellectual property laws. You may not copy, modify, or create derivative works without our written permission.

10. Limitation of Liability

To the maximum extent permitted by law:

  • Bot-Call is provided "as is" without warranties of any kind
  • We are not liable for indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid in the 12 months preceding the claim
  • We are not responsible for errors in AI responses or missed calls

11. Indemnification

You agree to indemnify and hold Bot-Call harmless from any claims, damages, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you provide to the Service

12. Termination

We may terminate or suspend your account immediately if you:

  • Violate these Terms of Service
  • Engage in fraudulent or illegal activity
  • Fail to pay subscription fees
  • Misuse the Service in any way

Upon termination, your right to use the Service will cease immediately.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law
